These Terms & Conditions ("Terms") govern your use of the Chef Q's Kitchen website, meal prep ordering form, catering and bartending booking, and any communication with us through WhatsApp, SMS, phone, or email (together, the "Services"). By placing an order, submitting a form, or messaging us, you agree to these Terms.

1. Acceptance of Terms

By using our website, submitting an order through our online form, messaging us on WhatsApp, or contacting us by phone or email to place an order, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our Services.

You must be at least 18 years old to place an order with Chef Q's Kitchen.

2. Who We Are

Chef Q's Kitchen LLC ("Chef Q's Kitchen," "we," "us," or "our") is a meal prep, catering, and bartending service registered and operated in the State of New Mexico, serving the El Paso, Texas / Sunland Park, New Mexico border area.

3. Services We Offer

Chef Q's Kitchen provides:

• Weekly Meal Prep — customizable plates, wraps, and breakfast items, ordered through our online form.
• Catering — event catering packages, booked by request/consultation.
• Bartending — bartending services for private events, booked by request/consultation.

Availability, menu items, and pricing are subject to change without notice and may vary by season or ingredient availability.

4. How Ordering Works

Meal prep orders can be placed by:

• Completing the order form on our website, which sends your order to us via WhatsApp; or
• Using the email fallback option if WhatsApp is not available to you.

Catering and bartending requests are booked through our scheduling link (Calendly) or by contacting us directly.

You are responsible for reviewing your order summary (proteins, flavors, sides, add-ons, delivery address, and total) before sending it. Chef Q's Kitchen is not responsible for errors in an order caused by incorrect selections made by the customer, but we will always do our best to catch obvious mistakes and confirm with you before preparing your order.

5. Order Deadlines & Delivery Schedule

Meal prep orders close every Friday at 5:00 PM and are delivered or available for pickup starting Sunday after 6:00 PM. Orders submitted after the weekly cutoff will be held for the following week unless otherwise arranged with us directly.

A minimum order of 5 plates is required. Orders of 15 or more plates qualify for bulk pricing and free delivery.

6. Pricing & Payment

Prices for meal prep items are shown on the order form at the time of ordering and may change from week to week. The total shown at checkout, including any delivery fee, reflects the price you will be charged for that order.

Payment is due at the time of ordering.

Some add-ons, such as certain salsas, may have variable pricing that is confirmed by Chef Q directly rather than shown automatically on the order form.

7. Delivery Area & Delivery Fees

Delivery fees are calculated based on the estimated driving distance between our kitchen and the delivery address you provide:

• 0–5 miles: FREE
• 6–10 miles: $3
• 11–15 miles: $7
• 16+ miles: $10
• Bulk orders (15+ plates): delivery always FREE

Delivery fees shown on the order form are estimates based on mapping data at the time of ordering and are confirmed by Chef Q's Kitchen before your order is finalized. We reserve the right to adjust a delivery fee, or decline delivery to a location outside our normal service area, and will always communicate this with you before preparing your order.

Chef Q's Kitchen is registered and operated in New Mexico and delivers into Texas in compliance with the applicable food service laws of both states.

You are responsible for providing accurate delivery instructions (gate codes, apartment numbers, drop-off location). Chef Q's Kitchen is not responsible for delays or failed deliveries caused by incomplete or inaccurate information.

8. Cancellations & Refunds

Orders can be changed or cancelled free of charge up until 10:00 PM on Friday — five hours after our 5:00 PM order cutoff. This gives us a short window after ordering closes, but once that window passes, food preparation has begun and orders are final and non-refundable.

The only exception is if Chef Q's Kitchen is unable to fulfill your order — in that case, you'll receive a refund or a credit toward the following week's order.

If there is an error with your order (wrong item, missing item, or a food safety concern), please contact us within [24 hours] of delivery/pickup so we can make it right.

9. Food Allergies & Dietary Disclaimers

Our kitchen prepares food that may contain or come into contact with common allergens, including but not limited to dairy, eggs, wheat/gluten, soy, tree nuts, peanuts, fish, and shellfish. While we are happy to accommodate dietary requests where possible, we cannot guarantee that any dish is completely free of a specific allergen due to shared kitchen equipment and preparation space.

If you have a food allergy or sensitivity, please tell us before ordering. It is your responsibility to inform us of any allergies; Chef Q's Kitchen is not liable for reactions resulting from undisclosed allergies or sensitivities.

10. Bartending & Alcohol Service

Bartending services are provided for private events by request. Alcohol service is subject to applicable state and local laws in the jurisdiction where the event takes place.

• Guests being served alcohol must be 21 years of age or older and may be asked to show valid government-issued ID.
• Chef Q's Kitchen reserves the right to refuse service to any guest who appears intoxicated or is unable to provide valid ID.
• The event host (the person hiring Chef Q's Kitchen) supplies all alcohol served at the event. Chef Q's Kitchen does not sell, provide, or bring alcohol to events.
• Chef Q's Kitchen follows applicable New Mexico and Texas alcohol service laws, as well as the specific rules of the event venue, for the entire time alcohol is served — from the event's start time through its designated service cutoff time.

The event host is responsible for ensuring the event complies with local alcohol service laws and venue requirements.

11. WhatsApp, SMS & Email Communications

By submitting an order or contacting us through our website, WhatsApp, or phone number, you consent to receive messages from Chef Q's Kitchen related to your order, including confirmations, delivery updates, and questions about your order.

We do not sell or share your phone number or contact information with third parties for marketing purposes. Standard message and data rates from your mobile carrier may apply. You can ask us at any time to stop receiving non-essential messages by telling us directly via WhatsApp, phone, or email.

12. Your Information

We collect the information you provide when placing an order (name, phone number, delivery address, order details) only to fulfill that order and communicate with you about it. We do not retain this information beyond what's needed to complete your order, and we do not sell your personal information to third parties.

13. Limitation of Liability

To the fullest extent permitted by law, Chef Q's Kitchen LLC and its owners, employees, and contractors are not liable for any indirect, incidental, or consequential damages arising from the use of our Services, including but not limited to delays in delivery, food quality concerns not reported within [24 hours], or issues arising from inaccurate information provided by the customer.

Our total liability for any claim related to an order is limited to the amount paid for that order.

14. Intellectual Property

All content on our website and order form, including recipes, menu descriptions, photos, and branding, is the property of Chef Q's Kitchen LLC and may not be copied or reused without permission.

15. Governing Law

These Terms are governed by the laws of the State of New Mexico, where Chef Q's Kitchen LLC is registered and operated. Deliveries into Texas are made in compliance with applicable Texas food service laws in addition to New Mexico law.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes in our menu, pricing, delivery area, or operations. The version posted on our website is always the most current. Continuing to place orders after changes are posted means you accept the updated Terms.
